Terms & Conditions

1. Scope, contractual partner

These Terms and Conditions apply to all orders placed through our online shop. The contractual partner is:

Customers are consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB).

2. Offers and conclusion of contract

Product presentations in the shop are non-binding.
By clicking “Buy”, you submit a binding offer. We accept your order by sending an order confirmation by email or by delivering the goods. We store the contract text; the contract language is German. You can view the order details in your customer account.

3. Prices, shipping costs, unit prices

All prices are in EUR and include the applicable statutory VAT. Unless otherwise stated, additional shipping costs apply and are shown at checkout. For food products, where required by law, we state the unit price per 100 g / 1 kg on the product page (PAngV).

4. Payment methods and due dates

We offer the following payment methods (availability may vary depending on the shopping cart, creditworthiness and country of delivery):

  • Stripe (credit/debit card): Charged immediately when the order is completed.

  • Klarna (“Pay in full today”, “Pay later”, “Spread the cost”): Payment through Klarna Bank AB. For individual options, Klarna may perform an identity and creditworthiness check; Klarna’s terms apply.

  • PayPal: Payment through your PayPal account or the payment methods stored there.

  • Advance payment/bank transfer: Due within 7 calendar days after the order. Shipping takes place after payment has been received.

5. Delivery, delivery area, transport risk

We deliver within Germany as standard; deliveries to other EU countries are possible (conditions at checkout or on the “Shipping & Delivery” page).
Partial deliveries are permitted insofar as they are reasonable for you; we bear the additional costs.
Consumer goods purchase: The risk of loss/deterioration passes only upon handover to you (not upon handover to the carrier). Please document and report damage promptly.

6. Shipping & refrigerated goods (especially caviar)

For highly perishable products (e.g. caviar), we use suitable refrigerated/insulated packaging. Please store the goods immediately after receipt in accordance with the storage instructions (e.g. refrigerator temperature). Damage resulting from improper storage after handover does not constitute a defect.

7. Retention of title

The goods remain our property until payment has been made in full.

8. Right of withdrawal for consumers / exceptions

The statutory 14-day right of withdrawal applies. The complete withdrawal instructions, including the model form, can be found on our “Withdrawal” page.
Important exceptions:

  • Goods liable to deteriorate rapidly or goods with a short expiry date (e.g. fresh food) are excluded from withdrawal.

  • Sealed goods which are not suitable for return for reasons of health protection/hygiene, if the seal has been removed, are also excluded.
    Where withdrawal is possible, you bear the direct costs of returning the goods if we have informed you accordingly.

9. Statutory liability for defects (warranty)

The statutory rights apply in the event of defects. For consumers, the limitation period is 2 years from delivery. Irrespective of this, any manufacturer warranties remain unaffected; their terms can be found with the respective product, where applicable.

10. Liability

We have unlimited liability for intent and gross negligence.
In the event of ordinary negligence, we are liable only for the breach of material contractual obligations (cardinal obligations) – in that case limited to the foreseeable damage typical of the contract. Liability for injury to life, body or health remains unaffected. Mandatory liability under the ProdHaftG remains unaffected.

11. Vouchers / discount codes

Vouchers/discount codes can be redeemed only within the stated period and under the respective stated conditions; cash payment is excluded. Misuse results in the invalidity of the benefit.

12. Set-off / retention

You are entitled to rights of set-off only if your counterclaim has been finally adjudicated, is undisputed or is ready for a decision. A right of retention exists only insofar as your counterclaim is based on the same contractual relationship.

13. Consumer dispute resolution (VSBG)

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
Note: The former EU ODR platform was discontinued on 20 July 2025; the corresponding references no longer apply.

14. Applicable law, place of jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory consumer protection provisions of the country of their habitual residence continue to apply.
The place of jurisdiction for merchants is our registered office.

15. Changes to the Terms and Conditions

We may amend these Terms and Conditions if there are objective reasons for doing so (e.g. a change in the law, product range/processes). For ongoing contracts, the Terms and Conditions in the version available at the time the contract was concluded apply.
